4. Activity and regulatory framework

Nadia Immo Services carries out a real estate intermediation activity: connecting owners, sellers and landlords on one side with buyers and tenants on the other, as well as publishing listings and managing rentals. This activity is carried out in compliance with Senegalese law, in particular:

• Law No. 2008-08 of 25 January 2008 on electronic transactions, for services provided online;
• the Code of Civil and Commercial Obligations (COCC), regarding mandate, sale and lease;
• Law No. 2011-07 of 30 March 2011 establishing the land ownership regime and the rules of the land registry (land title, transfer, registration);
• Law No. 94-63 of 22 August 1994 on prices, competition and economic litigation, for consumer information.

The involvement of Nadia Immo Services does not replace that of the notary, the only party authorised to draw up authentic deeds of sale and to carry out transfer formalities with the land registry. Any transaction remains subject to the usual checks on the legal status of the property (land title, lease, real rights, charges).

5. Published listings

The listings published on the Site come either from Nadia Immo Services, or from agents, partner agencies, developers or registered individuals. Each listing submitted by a third party is subject to prior moderation before publication, but this check guarantees neither the complete accuracy of the information, nor the actual availability of the property, nor the regularity of the land situation, which are the responsibility of the submitter.

The user is invited to carry out their own checks, in particular with a notary and the land registry, before any commitment or payment.

6. Intellectual property

The graphic identity, texts, logo and structure of the Site are protected under Law No. 2008-09 of 25 January 2008 on copyright and related rights in Senegal. Any reproduction or representation, in whole or in part, without prior written authorisation, is prohibited. The photographs and descriptions of the properties remain the property of their respective submitters.

7. Liability

Nadia Immo Services does everything possible to ensure the accuracy and updating of the information published, without being able to guarantee its completeness. Its liability cannot be engaged in the event of an interruption of the Site, an error in a listing provided by a third party, or the use made of the information by the user. Links to third-party sites are provided for convenience: Nadia Immo Services exercises no control over their content.

8. Terms of use

By accessing the Site and creating an account, the user accepts the following conditions:

• provide accurate information when registering and submitting listings;
• only submit listings for real properties that they have the right to dispose of or offer;
• not publish any unlawful, misleading, defamatory content or content contrary to public decency;
• keep their login credentials confidential;
• use the Site in accordance with its intended purpose, without disrupting its operation.

Nadia Immo Services reserves the right to suspend or delete, after review, any account or listing that does not comply with these rules, without prejudice to any legal proceedings.

9. Personal data

The processing of personal data is described in our privacy policy, established in accordance with Law No. 2008-12 of 25 January 2008 on the protection of personal data and under the supervision of the Commission for the Protection of Personal Data (CDP).

10. Applicable law and jurisdiction

This legal notice is governed by Senegalese law. Any dispute relating to the use of the Site falls, failing amicable settlement, within the jurisdiction of the courts of Dakar.
